A despolitização do Supremo Tribunal Federal
O país tem sido palco de decisões polêmicas do Judiciário, o que sugere a necessidade de revisão constitucional das atribuições do presidente da República de indicar e nomear os ministros dos tribunais superiores (STF, STJ, TST, TSE e STM), do TCU, bem como de escolher em lista tríplice aquele que será nomeado desembargador, com base na regra do “quinto” constitucional – Art. 94 CF.
Temos que despolitizar o Judiciário ( STF), infestado de políticos de toga, para que a instituição tenha credibilidade em suas decisões, diante da sociedade.
Os exemplos de decisões emblemáticas, que põem em xeque a imparcialidade de ministros e desembargadores, de indicações e nomeações políticas, podem ser constatados na Segunda Turma do STF, com a atuação controvertida dos ministros, tidos como petistas, Ricardo Lewandowski e Dias Toffoli, que se posicionaram a favor da libertação de José Dirceu, condenado pela segunda instância a trinta anos de prisão, bem como pela decisão rocambolesca do desembargador do TRF-4, Rogério Favreto, ex-filiado ao PT, nomeado por Dilma Rousseff sem ter sido juiz de coisa alguma e que mandou soltar Lula.
Não pode funcionar bem e com total isenção uma corte ou tribunal de indicação e nomeação política. Os ministros dos tribunais superiores e os desembargadores deveriam ser pinçados apenas dos quadros do Judiciário. São os juízes de carreira que têm o perfil de julgador: nem advogados e nem promotores.
Quanto ao Tribunal de Contas da União (TCU) – não obstante as várias interpretações constitucionais, o entendimento majoritário é no sentido de ser o TCU um órgão de extração constitucional, independente e autônomo, que auxilia o Congresso Nacional no exercício do controle externo -, os seus ministros deveriam ser escolhidos exclusivamente do quadro de auditores
Com respeito à vitaliciedade dos cargos, excetuando os desembargadores, os demais (ministros dos tribunais superiores e do TCU) deveriam ter mandatos fixos de dez anos e não poderiam ser reconduzidos ao cargo.
