Arthur Lira deve anular impeachment se Rodrigo Maia assinar nesta 2ª feira
O favorito para ser eleito presidente da Câmara nesta 2ª feira (1º.fev.2021), Arthur Lira (PP-AL) deve anular a eventual assinatura de um pedido de impeachment contra Jair Bolsonaro que seja despachado hoje por Rodrigo Maia (DEM-RJ).
O Poder360 apurou que o caminho a ser seguido por Lira sustentará a argumentação, um tanto controversa, de que Rodrigo Maia somente poderia ter tomado esse tipo de decisão até domingo (31.jan.2021). Para o grupo que apoia Lira, a única função a ser desempenhada hoje por Maia é convocar e presidir a sessão preparatória na qual será eleito o novo presidente da Câmara.
Se Rodrigo Maia realmente assinar o pedido de impeachment e Arthur Lira vier a ser eleito, são reais as chances de o eventual processo (ou anulação do processo) contra Bolsonaro ser contestado no STF (Supremo Tribunal Federal).
Uma leitura da Constituição e do Regimento Interno da Câmara indica que é difícil sustentar essa tese.
No artigo 57 da Constituição está escrito apenas o seguinte, em seu parágrafo 4º: “Cada uma das Casas [Câmara e Senado] reunir-se-á em sessões preparatórias, a partir de 1º de fevereiro, no primeiro ano da legislatura, para a posse de seus membros e eleição das respectivas Mesas, para mandato de 2 (dois) anos, vedada a recondução para o mesmo cargo na eleição imediatamente subsequente”.
O Regimento Interno da Câmara dos Deputados estabelece o seguinte em seu artigo 6º (o que mais chama a atenção é o parágrafo 3º):
“Art. 6º No terceiro ano de cada legislatura, em data e hora previamente designadas pelo Presidente da Câmara dos Deputados, antes de inaugurada a sessão legislativa e sob a direção da Mesa da sessão anterior, realizar-se-á a eleição do Presidente, dos demais membros da Mesa e dos Suplentes dos Secretários.
- 1º (Revogado).
- 2º (Revogado).
- 3º Enquanto não for eleito o novo Presidente, dirigirá os trabalhos da Câmara dos Deputados a Mesa da sessão legislativa anterior”.
Há um entendimento consolidado no STF segundo o qual o Tribunal não deve se envolver em assuntos internos dos outros Poderes. Ou seja, por essa tese, não caberia ao Supremo se posicionar sobre se Rodrigo Maia teria ou não poderes para tomar decisões hoje como presidente da Câmara, inclusive assinando o pedido de impeachment de Bolsonaro.
No domingo (31.jan.2021), Rodrigo Maia ameaçou assinar algum pedido de impeachment contra Bolsonaro depois que a Comissão Executiva Nacional do Democratas decidiu não entrar no bloco de apoio ao deputado Baleia Rossi (MDB-SP) para presidir a Câmara. Em seguida, ao saber da decisão do DEM, o PSDB também optou por não participar do grupo pró-Baleia.
